Use of the software.

Purchaser of any Wend Image CD or image may:
1. Copy the Wend Image CD or image to a single computer or other storage device to be used only by the original purchaser of the image or CD collection.
2. Make one backup copy of the software, provided your backup copy is not installed or used on any computer.

HOME USE: The primary user of each computer on which the Wend Image CD or image is installed or used, may also copy it onto one home or portable computer. However, the Product may not be used on the secondary computer by another person at the same time the Product on the primary computer is being used.

Rights and usage. You may:
1. Use Wend Images for illustrative or decorative purposes for printed communication
(e.g. advertisements, publications, newspapers, brochures, reports and newsletters).

2. Use Wend Images for electronic and/or multimedia communications (presentations, training programs, video, and web page design). The images must be at a resolution no greater than 72 dpi. and must be both decorative in nature and must not be the primary value or purpose of the production. For example, you may incorporate an image as a document element on a web page, but you may not use the images in an application program where the images represent the primary value (e.g. a screen saver program).

3. Incorporate or modify the images and use them in a non-electronic product for resale, except where the image is the primary value or purpose of the production. For example, you may incorporate an image into a total design on a T-shirt or poster as long as the image is one component of an overall graphic design and not a stand alone feature of that T-shirt or poster.

4. Make one copy of a Wend Image file when using an outside service bureau or high resolution output service. This copy is for one time use only and must be removed from the service bureau's possession upon completion of the service.

With Wend Images you may not...
1. Use or copy the Wend Images CD, or any part thereof, and/or the written materials accompanying the product except as permitted by this Agreement.

2. Use or permit the use of Wend Images CD's, or any part thereof, in or in association with fraudulent, pornographic or defamatory, immoral or illegal material.

3. Use or permit the use of Wend Images, or any part thereof, as a trademark or service mark, or claim any proprietary rights of any sort to the image(s), or any part thereof.

4. Sell or distribute any Wend Images product, as a stock image, either alone or as part of a stock file library in any format.

5. Sell or distribute Wend Images material in any packaged form as printed material, decals, vinyl transfers, paint masks or stencils.

6. Sell, share, lend or otherwise distribute Wend Images through any network - electronic or print.

7. Sell, share, lend or otherwise distribute Wend Images over the internet.

Ownership:
Customer agrees that they do not have any title or ownership of the software, other than ownership of the physical media. Customer acknowledges and agrees that the software is copyrighted and protected under the copyright laws.

Copyright:
The software is owned by Daniel Wend /Wend Images and its structure, organization and code are the valuable proprietery property of Wend Image. The software is also protected by United States Copyright Law and International Treaty provisions. You must treat the Software just as you would any other copyrighted material, such as a book. You may not copy the Software or the Documentation, except as set forth in the "Use of the Software" section. Any copies that you are permitted to make pursuant to this Agreement must contain the same copyright and other proprietary notices that appear on or in the Software. You agree not to modify, adapt, or translate the Software. You also agree not to decompile, dissassemble, or otherwise modify the Software. This agreement does not grant you any intellectual property rights to the Software.

Transfer:
You may not rent, lease, sublicense or lend the Software or Documentation. You may, however, transfer all your rights to use the Software to another person or legal entity, provided that you transfer this agreement, the Software, including , all copies, updates and prior versions and all files converted into other formats, and all Documentation to such person or entity and that you retain no copies, including copies on a computer. All other fees and contracts must be negotiated with Daniel Wend.
